1.
General Terms and Conditions
1.1. These general terms and
conditions apply to the legal relationships from ordering books, CDs and other
goods (hereinafter – the product or products) from the online shop of SA Arvo
Pärdi Keskus (hereinafter – the Arvo Pärt Centre) at shop.arvopart.ee
(hereinafter – the online shop).
1.2. In addition to these general
terms and conditions, the relationships between customers and the Arvo Pärt
Centre are governed by the legal regulations valid in the Republic of Estonia,
the Arvo Pärt Centre’s procedure for processing the personal data of customers
(Privacy policy), the price list for products in the online shop, and
established good practices.
1.3. These general terms and
conditions, the Privacy policy, and the current price list for products
available in the online shop can be accessed on the website of the online shop.
2.
Ordering products
2.1. You can order products as a visitor
of the online shop.
2.2. The customer will select the
desired product(s), specify their quantity, and the payment and delivery
method. Before the final confirmation of the order, it is possible to review it
and make changes if necessary. After that, the order can be confirmed. The
order can be placed in Estonian or English.
2.3. All product prices displayed
in the online shop are inclusive of VAT.
2.4. A delivery fee will be added
to the price of the ordered products according to the chosen method of
delivery.
2.5. The confirmed order can be
paid by bank link, invoice, or credit card. Payments are handled by Maksekeskus AS.
2.6 The controller of your personal data is: SA Arvo Pärdi Keskus, who forwards the necessary personal to the authorized processor Maksekeskus AS, to make the payments.
2.6. The Arvo Pärt Centre has
received the order when an order confirmation has been issued to the customer.
2.7. The order will take effect
upon payment.
3.
Product delivery
3.1. The Arvo Pärt Centre will
deliver the ordered products according to the method selected by the customer:
either by registered mail to a post office, or to a parcel machine (Omniva or
Itella Smartpost).
3.2. The delivery method is
selected when placing the order, and the prices are fixed in the price list
visible at the time of placing the order.
3.3. The product is dispatched to
the customer within the time specified in the online shop, by the delivery
method selected by the customer, within two weeks. The delivery times indicated
in the online shop are valid only within the Republic of Estonia. For delivery
abroad, see section 3.4.
3.4. Orders and delivery outside
the Republic of Estonia
3.4.1. The
Arvo Pärt Centre also welcomes orders from outside the Republic of Estonia.
Customers abroad should add the desired products to their cart, choose their
country of location and enter their delivery address. Depending on the country,
it will take 7–30 days to complete the order.
3.4.2.
The
fees for deliveries outside the Republic of Estonia are fixed and displayed on
the invoice before the purchase is confirmed.
3.5. If the Arvo Pärt Centre cannot
deliver an order due to circumstances arising from the customer, the order will
be cancelled. The Arvo Pärt Centre will withhold the delivery fee of the order,
and the balance of the amount paid for the order will be returned to the
customer’s bank account.
4.
The consumer’s right of
withdrawal
4.1. The consumer placing the order
has the right to cancel the order of the products without providing a reason
from the moment of placing the order and within 14 calendar days after
receiving the products.
4.2. If the product returned by the
consumer is used or damaged in any way other than is necessary to verify the
nature, characteristics or functionality of the product, the Arvo Pärt Centre
has the right to claim compensation for the damages according to the reduction
in the product value, up to the full sale price of the product. This sum is
deducted from the amount returned to the consumer.
4.3. To cancel or withdraw from an
order, the consumer must submit an application to the Arvo Pärt Centre in
writing, by e-mail or verbally on site, or use the standard form for an
application of withdrawal, available on the website of the Arvo Pärt Centre
online shop.
4.4. The application for withdrawal
from an order must contain the bank account details and the name of the owner
of the bank account into which the refund is to be transferred.
4.5. If the consumer cancels an
order, they shall return the product(s) without delay, and not later than within
14 calendar days from the moment of submitting the application for the cancellation.
Products can be returned to the front desk of the Arvo Pärt Centre or by mail
to: SA Arvo Pärdi Keskus, Kellasalu tee 3, Laulasmaa, 76702 Lääne-Harju vald.
The consumer is responsible for expenses related to returning items.
4.6. The Arvo Pärt Centre will
reimburse the price paid for the returned products and the delivery fee to the
consumer. If the ordered products have been returned only partially, the
delivery fees are reimbursed proportionate to the amount of the ordered
products. The Arvo Pärt Centre will refund the money without delay, and not
later than 14 calendar days from receiving the application for withdrawal, but not
before the consumer has returned the product(s) to the Arvo Pärt Centre or
presented proof that the product(s) has/have been returned.
5.
The customer’s rights
5.1. The customer has the right to
order products from the Arvo Pärt Centre online shop according to the specified
prices and conditions.
5.2. The placed order must be complete
and of proper quality, and meet the conditions set by the Arvo Pärt Centre.
5.3. Complaints about the order and
products can be submitted to the Arvo Pärt Centre at Kellasalu tee 3,
Laulasmaa, 76702 Lääne-Harju vald, or by e-mail to info@arvopart.ee within two
years of receiving the product. With regard to deficiencies that have become
apparent within six months from the date of delivery to the customer, it is
assumed that the deficiency existed at the time of delivery, if such an
assumption does not contradict the nature of the product or the defect. The
Arvo Pärt Centre must be notified about the non-compliance of the product
within two months after the customer became aware of its non-compliance. In the
case of a defect, the product will be replaced by an identical item, unless the
given product is no longer in stock. If a corresponding product is not
available, the product will be replaced with an equivalent specified by the
customer, or the sales contract will be terminated and the cost of the product
will be refunded to the customer.
5.4. The customer has the right to
withdraw from the order in accordance with Section 5.
5.5. The customer has the right to use
means of legal protection provided by law if the product is not compliant with
the terms and conditions of the contract.
6.
The customer’s obligations
6.1. When placing an order, the
customer must provide the information necessary to complete the order: first
and last name, exact address (street, house and apartment number, post code,
city/town, or village/county), contact phone and e-mail address.
6.2. If the customer and the
recipient of the product are not the same, the information specified in Section
8.1 must also be provided for the recipient.
6.3. If the information provided by
the customer is incorrect and/or incomplete and does not correspond to the
conditions in Section 8.1, the Arvo Pärt Centre cannot guarantee that the order
is completed properly. If possible, the Arvo Pärt Centre will contact the
customer to review the incorrect or incomplete information.
6.4. Upon placing the order, the
customer agrees with these terms and conditions and undertakes to comply with
them.
7.
The rights of the Arvo Pärt
Centre
7.1. The Arvo Pärt Centre has the
right to make changes to these terms and conditions without notice, by
publishing the new terms and conditions on the website of the online shop.
7.2. The Arvo Pärt Centre has the
right to make changes to the price list of the online shop without notice, by
publishing the new price list on the website of the online shop.
7.3. The Arvo Pärt Centre does not
guarantee that the description of the contents of the product corresponds to
the customer’s opinion about the contents of the product.
7.4. If the customer does not meet
their obligations specified in these terms and conditions, the Arvo Pärt Centre
cannot guarantee that the order is finalised and/or duly dispatched.
7.5. If the customer does not meet
the payment obligation correctly, the Arvo Pärt Centre has the right to publish
the customer’s details on the register of payment violations.
8.
The obligations of the Arvo
Pärt Centre
8.1.
The
Arvo Pärt Centre shall deliver the correct product(s) to the customer in
accordance with the order.
8.2.
The
Arvo Pärt Centre must accept and document all customer complaints.
8.3.
The
Arvo Pärt Centre shall resolve customer complaints within 7 working days, if
the circumstances of the complaint are not dependent on the customer. If the
reason for the complaint was caused by the customer, the customer must remove
it immediately.
8.4.
The
Arvo Pärt Centre must replace any faulty items. The Arvo Pärt Centre is only
liable for manufacturing defects and similar deficiencies that were present
when the product was delivered to the customer.
8.5.
All
disputes between the parties shall be resolved by negotiation. If no agreement
is reached, and the customer wishes to take their complaint further, the
customer has the right to turn to:
8.5.1.
the
Consumer Dispute Committee of the Consumer Protection and Technical Regulatory
Authority at Pronksi 12, Tallinn 10117, e-mail: info@tarbijakaitseamet.ee. The
Consumer Dispute Committee has jurisdiction to resolve contract-related disputes
between consumers and businesses that the parties have failed to resolve by
agreement. The review of the complaint by the Committee is free of charge for
the parties. The application can be submitted at: https://komisjon.ee.
8.5.2.
The
Online Dispute Resolution (ODR) platform, provided by the European Commission
for consumer complaints regarding online shopping:
http://ec.europa.eu/consumers/odr/. The ODR platform is primarily intended for,
but not limited to, resolving cross-border disputes, enabling the consumer to
find a suitable extrajudicial authority in another member state for resolving
the dispute;
8.5.3.
the
court of law.
